On January 1, 2022, the Regional Comprehensive Economic Partnership Agreement (RCEP) will enter into force. This
means that the free trade zone with the largest population, the largest
economy and trade scale and the most potential for development in the
world has really come.
As the
largest free trade zone in the world, after the entry into force of the
RCEP agreement, more than 90% of the trade in goods between approved
members will eventually achieve zero tariff.
For
foreign trade enterprises, this is a huge dividend-after the entry into
force of RCEP, nearly 30 per cent of China's exports can achieve zero
tariff treatment, covering China's trade volume of 1.4 trillion US
dollars.
Starting from January 1, import and export tariffs on some commodities will be adjusted.
Starting
from January 1, 2022, China will impose a provisional import tariff
rate lower than that of the most-favoured-nation (MFN) on 954
commodities. It includes the
implementation of zero tariff on radium chloride injection, a new
anticancer drug, and the reduction of import tariffs on some medical
products such as intracranial thrombectomy stents, artificial joints and
so on.
Starting from January 1,
2022, import and export tariffs on some commodities will be raised
within the commitment of China's accession to the World Trade
Organization. Among them, abolish the
import provisional tariff rate on some amino acids, lead-acid battery
parts, gelatin, pork and m-cresol, resume the implementation of the
most-favored-nation tax rate, and raise export tariffs on phosphorus and
crude copper in order to promote the transformation and upgrading and
high-quality development of related industries.
The measures for the Administration of approved exporters will enter into force on January 1.
The
General Administration of Customs has promulgated the measures of the
people's Republic of China on the Administration of approved exporters
(hereinafter referred to as the measures), which will enter into force
on January 1, 2022.
It is clear in
the measures that an enterprise applying to become an approved exporter
must meet three conditions: first, it must be an enterprise with
advanced customs certification; second, it should master the rules of
origin under the relevant preferential trade agreements; third, it is
necessary to establish a complete management system of origin
qualification documents.
Temporary exemption of domestic sales tax and interest of processing trade enterprises in 2022.
In
order to implement the spirit of the executive meeting of the State
Council, the Ministry of Finance issued the notice on temporary
exemption of domestic sales tax and interest on domestic sales of
processing Trade Enterprises in 2022, specifying that from January 1,
2022 to December 31, 2022, temporary exemption from domestic sales tax
and interest of processing trade enterprises. The
introduction of this policy is conducive to doing a good job in
cross-cycle adjustment, helping enterprises to relieve hardship,
especially supporting small and medium-sized enterprises, ensuring
orders and stabilizing expectations, actively responding to the current
uncertain, unstable and unbalanced factors in foreign trade, and
promoting the steady development of foreign trade.
The measures for the Administration of Import and Export Food Safety will come into effect on January 1.
The
measures of the people's Republic of China on the Administration of
Import and Export Food Safety shall enter into force on January 1, 2022. Imported food that has been assessed and qualified by the Customs shall be allowed to be imported. If
the imported food is not up to standard after the customs conformity
assessment, the customs shall issue a non-conformity certificate; if the
safety, health or environmental protection projects are not up to
standard, the customs shall notify the food importer in writing and
order them to destroy or return them; if other items are unqualified,
only those that meet the requirements of conformity assessment after
technical treatment shall be allowed to be imported. If
the relevant imported food fails to complete the technical treatment
within the prescribed time, or is still unqualified after the technical
treatment, the customs shall order the food importer to destroy or
return the goods.
The cancellation of registration by consignees of imported meat and cosmetics will take effect on January 1.
In
order to further deepen the reform of "release, management and
service", continuously optimize the business environment at the port and
lighten the burden on enterprises, the General Administration of
Customs has decided to cancel the filing of imported meat consignees and
imported cosmetics consignees, which shall be implemented as of January
1, 2022.

Announcement on the declaration of import and export of epidemic prevention and control materials such as testing kit.
In
order to facilitate enterprise declaration and efficient customs
supervision, further improve the accuracy of declaration and statistics
of materials for COVID-19 epidemic prevention and control, and serve the
overall situation of epidemic prevention and control, according to the
2022 tariff Adjustment Plan (issued by the Taxation Commission (2021)
No. 17), the import and export declaration of epidemic prevention and
control materials such as novel coronavirus testing kit is hereby
announced as follows. It will come into effect on January 1, 2022.
The new negative list of foreign trade access will come into effect on January 1.
The
Special Management measures for Foreign Investment access (negative
list) (2021 Edition) and the Special Management measures for Foreign
Investment access (negative list) (2021 Edition) in the Free Trade pilot
Zone will enter into force as of January 1, 2022. The
2021 version of the negative list of foreign investment in the national
and free trade pilot zones has been further reduced to 31 and 27, with
major changes:
First, we will further deepen the opening up of the manufacturing industry. In
the field of automobile manufacturing, the restrictions on the share
ratio of foreign investment in passenger car manufacturing and the
restrictions on the establishment of two or less joint ventures
producing similar vehicle products by the same foreign businessman in
China will be abolished. In the field of
radio and television equipment manufacturing, the restrictions on
foreign investment in satellite television broadcasting ground receiving
facilities and the production of key parts shall be abolished and
managed in accordance with the principle of consistency between domestic
and foreign capital. This revision has realized the zero clearance of manufacturing items in the negative list of the free trade pilot zone.
Second, the free trade pilot zone will explore ways to relax access to the service industry. In
the field of market research, except for radio and television listening
and viewing surveys, which must be controlled by the Chinese side,
restrictions on the entry of foreign investment shall be lifted. In
the field of social investigation, foreign investors are allowed to
invest in social investigation, but the Chinese share ratio is required
to be not less than 67%, and the legal representative shall have Chinese
nationality.
The third is to improve the accuracy of the negative list of foreign capital access. The fourth is to optimize the negative list management of foreign investment access.
China-Brazil AEO Mutual recognition will be implemented on January 1st.
China-Brazil
Customs AEO Mutual recognition arrangement (hereinafter referred to as
"Mutual recognition arrangement") will be implemented tomorrow (January
1, 2022).
After the implementation
of the mutual recognition arrangement, the customs of China and Brazil
will directly apply lower document examination rate, lower import
inspection rate and actual goods to the goods from each other's AEO
enterprises.
Julian
Dominguez, deputy minister of animal husbandry, said in a statement
that the measures announced by the government in the official bulletin
had been agreed with the production entities and the meat packing
industry and were aimed at providing predictability and confidence to
Argentine livestock. Ensuring Argentine production, exports and
consumption is based on technical analysis of the industry.
